Overview of the Notification

The Council of Scientific and Industrial Research has issued an Office Memorandum regarding the bye-election to the Bihar Legislative Council from the Bhojpur-cum-Buxar Local Authorities' Constituency. This directive follows communications from the Cabinet Secretariat and the Election Commission of India (ECI).

Key Model Code of Conduct (MCC) Provisions

  • Immediate Enforcement: The provisions of the Model Code of Conduct came into force immediately upon the election announcement on April 9, 2026.
  • Ministerial Restrictions: Both Central and State Ministers are prohibited from inaugurating or laying foundation stones for educational institutions within the constituency during the election period.
  • Prohibition on Official Tours: Ministers are strictly forbidden from combining official government tours with any election-related work or campaigning.
  • Policy Announcements: There is a total ban on announcing new policy programs or initiatives that could influence the electorate of the polling constituency.
  • Transfer Ban: To ensure fairness, no Returning Officers (ROs) or Assistant Returning Officers (AROs) may be transferred from the date of the election announcement until the process is complete.
  • Dry Day Declaration: In accordance with the Representation of the People Act, 1951, "dry days" must be declared in polling areas during the election cycle.
  • Ethical Conduct: Practices such as housing electors in hotels or resorts are explicitly categorized as "bribing" and constitute a violation of the MCC and the IPC.
